David Haas completed his representation of an individual who was convicted of violating the Anti-Kickback Act and Bribery Concerning Programs Receiving Federal Funds. Our client admitted to receiving more than $2.5 million in bribes connected to subcontractors who hoped to and did perform work in connection with federal Energy Savings Performance Contracts (ESPCs). The case was litigated for nearly four (4) years. We were able to convince the government and the Court that, despite our client’s Federal Sentencing Guidelines range of 70-87 months, a non-prison sentence was appropriate. Our client was sentenced to three (3) years of probation without home confinement.
